Terms of Service

These Terms of Service govern your access to and use of POPCORN at popcornstudio.ai. Please read them carefully — by creating an account or using POPCORN, you agree to be bound by them.

1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you and [POPCORN Studio — your registered legal entity] ("POPCORN", "we", or "us"), operator of popcornstudio.ai. By creating an account or using POPCORN, you accept these Terms. If you use POPCORN on behalf of a business, you confirm you are authorised to bind that business, and "you" means that business.

2. The service

POPCORN is an AI-powered studio that turns a product link or photo into video advertisements and related media. We may add, change, or remove features at any time. The service is provided on an ongoing basis and may occasionally be unavailable for maintenance or for reasons outside our control.

3. Eligibility and your account

You must be at least 18 years old to use POPCORN. You agree to provide accurate account information, keep your login credentials confidential, and remain responsible for all activity under your account. Tell us promptly if you suspect any unauthorised use.

4. Kernels, plans, and billing

POPCORN runs on "Kernels" — in-app credits that the service consumes when it generates renders and performs other actions.

  • Kernels have no monetary value, are not a stored-value or payment instrument, cannot be exchanged for cash, and are not transferable between accounts.
  • You obtain Kernels through a subscription plan or by buying one-time top-up packs. Current prices and Kernel amounts are shown on our pricing page.
  • Subscriptions renew automatically at the end of each billing period, and your payment method is charged through Stripe until you cancel. You may cancel at any time, effective at the end of the current period.
  • Kernels included with a subscription roll over for a limited period as described on our pricing page; Kernels bought as one-time top-ups do not expire while your account remains active.
  • If a render fails to produce a usable output, the Kernels spent on it are automatically returned to your balance.
  • Except where required by applicable law or expressly stated by us, payments and purchased Kernels are non-refundable.
  • We may change prices and plan features; changes take effect from your next billing period, and we will give reasonable notice.
  • Prices may exclude taxes, which you are responsible for where they apply.

5. Your content and the licence you grant

You keep ownership of the product links, images, briefs, and other material you submit ("Your Content"). You grant POPCORN a worldwide, non-exclusive, royalty-free licence to host, store, process, and transmit Your Content — including to the AI providers described in our Privacy Policy — solely to operate, secure, and improve the service and to generate your outputs.

You are responsible for Your Content. You represent and warrant that you own or hold all rights necessary to the products, brands, trademarks, images, and links you submit, and that POPCORN's processing of them will not infringe any third party's rights or violate any law.

6. AI-generated output

POPCORN produces output using automated AI systems. Subject to these Terms and your payment of the applicable Kernels, you may use the videos and media you generate for your own advertising and commercial purposes.

You acknowledge that AI output may contain errors or inaccuracies, may not be unique and could resemble output generated for other users, is not legal, advertising, or professional advice, and is not guaranteed to be fit for any particular purpose. You are responsible for reviewing every output before using or publishing it, and for ensuring your use complies with applicable advertising, consumer-protection, intellectual-property, and platform rules.

7. Acceptable use

You agree not to use POPCORN to create, upload, or distribute content that:

  • is unlawful, fraudulent, deceptive, defamatory, hateful, harassing, or otherwise harmful;
  • infringes intellectual-property, privacy, publicity, or other rights;
  • uses a brand, product, trademark, or person's likeness that you do not have the right to use;
  • is sexually explicit, exploits or endangers minors, or promotes violence or illegal activity; or
  • constitutes false or misleading advertising.

You also agree not to misuse, overload, probe, or attempt to bypass the service or its limits; reverse engineer or copy the platform; resell or provide the service to third parties other than as your own end use; or access the service by automated means except as we expressly permit.

8. Intellectual property

POPCORN — including the POPCORN and Kernels names, the mascot, the software, designs, and all related materials — is owned by us or our licensors and is protected by intellectual-property laws. These Terms grant you no rights in them beyond the limited right to use the service.

9. Third-party services

POPCORN depends on third-party providers, including payment, hosting, and AI providers. Their availability is outside our control, and your use of features that rely on them may also be subject to their own terms.

10. Suspension and termination

You may stop using POPCORN and close your account at any time. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or to protect the service or other users. On termination, unused Kernels and access to Your Content may be lost. Provisions that by their nature should survive termination will survive.

11. Disclaimers

To the fullest extent permitted by law, POPCORN is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

12. Limitation of liability

To the fullest extent permitted by law, POPCORN and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the service will not exceed the greater of the total amount you paid us in the three months before the event giving rise to the claim, or USD 100.

13. Indemnification

You agree to indemnify and hold POPCORN harmless from claims, damages, losses, and reasonable costs arising out of Your Content, your use of the service, or your breach of these Terms or of any law or third-party right.

14. Governing law and disputes

These Terms are governed by the laws of [Dubai, United Arab Emirates], without regard to its conflict-of-law rules. The courts of that jurisdiction will have exclusive jurisdiction over any dispute arising from these Terms or the service, except where applicable law gives you the right to bring proceedings elsewhere.

15. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, give reasonable notice. By continuing to use POPCORN after changes take effect, you accept the updated Terms.
